As the energy industry has faced recent challenges from the COVID-19 pandemic and geopolitical and economic events, players are exploring opportunities to sell and acquire distressed oil and gas assets. This session will cover the process and strategies for using Section 363 of the Bankruptcy Code for these sales. We will discuss the reasons an E&P company may wish to pursue a sale through bankruptcy; the benefits and limitations of Section 363 sales for buyers, sellers, and other parties; the marketing, auction, and bankruptcy court approval process; and unique considerations for buyers and sellers of oil and gas assets through bankruptcy.
