The energy and mining industries find themselves swimming in new regulations, policies, and departmental guidance released in the waning days of the Obama Administration. These last-minute actions impact everything from air quality to compensatory mitigation and royalty civil penalties to the ownership of lands beneath the Missouri River within the Ft. Berthold Reservation. Congress and the Trump Administration, however, have promised to rescind or modify many of these rules and policies using tools such as the Congressional Review Act and basic executive authority – thus raising the same questions on everyone’s minds: Do I actually have to read this or will it go away? And, if it’s going away, how soon can that happen, and what does the world look like once it’s gone?
