On April 16, 2019, Governor Polis signed into law the final version of SB 19-181, known as the “Protect Public Welfare Oil and Gas Operations” legislation. SB 181 amends the Oil and Gas Conservation Act and other statutes to overhaul how oil and gas development is regulated in Colorado and give greater control to local governments. The amendments include: (i) jurisdictional changes, which greatly expand the authority of local governments over oil and gas development; (ii) prescriptive rulemaking requirements, which direct the Colorado Oil and Gas Conservation Commission ("COGCC") to undertake rulemaking on a wide array of subjects; and (iii) changes to the composition and qualifications of COGCC commissioners. While much still depends on subsequent rulemaking by the COGCC, and on action by local jurisdictions, SB 181 will be consequential for all operators and the consequences could be severe for some operators.
Join DGS for a panel discussion on SB 181 and the impact that it will have on the Colorado oil and gas industry. We will shed some light on the most significant amendments to the Oil and Gas Act, discuss the upcoming COGCC rulemakings, talk about what operators can expect from local governments, provide our perspective on how the changes to the Act could impact current and future oil and gas operations in Colorado, and discuss potential litigation issues. The program will conclude with a Q&A session.
